State Supreme Court rules on SEDA-COG Joint Rail Authority’s operating agreement vote

On Oct. 1, 2020, the Pennsylvania Supreme Court issued a decision in the litigation involving the SEDA-COG Joint Rail Authority’s Request for Proposals process for a new operating agreement. In the decision, the Court determined that the Authority’s July 2015 7-3 vote was a passing vote, which effectively awarded the new operating agreement to Carload Express, Inc. Six board members had abstained from the vote to avoid any appearance of bias in the process but were physically present in the meeting room. The Court’s decision clarifies the voting standard required of municipal authorities within this Commonwealth under the Municipality Authorities Act.  While the statute literally states that action may be taken by the vote of a majority of the “members present,” the Court held that pre-1937 common law requires that only those members actually voting be treated as “present.”

In light of this decision, the Joint Rail Authority recognizes that the July 8, 2015 vote awarded the operating agreement to Carload Express. The Authority does, however, also recognize that Phase 2 proposer and current rail operator, Susquehanna Union Railroad Company (“SURC”), has asserted counterclaims addressed to the alleged conduct of certain former Authority board members, and SURC has taken the position that those issues remain pending before the Clinton County Court of Common Pleas despite the Supreme Court’s resolution of the voting standard issue.  The Authority is hopeful that the Trial Court will swiftly consider these issues, as the matter is remanded back to it.

Irrespective of how SURC’s counterclaims are resolved, customers on the Authority’s rail lines should remain assured that uninterrupted rail service shall continue, as will the Authority’s mission of encouraging economic development, while preserving rail infrastructure throughout central Pennsylvania.

Bloomsburg East Street railroad crossing work to resume

BLOOMSBURG – East Street’s railroad grade crossing construction is now scheduled for later this month.

East Street/State Route 487 adjacent to State Route 11 will close at 8 a.m. Sept. 18 and reopen at 8 a.m. Sept. 23. A detour will be in place.

Jannotti Rail Consulting Inc. of Russell is the track engineer and Chesapeake Thermite Welding of Virginia is the contractor. The SEDA-COG Joint Rail Authority (JRA) owns the track and North Shore Railroad is the operator.

The SEDA-COG JRA was formed in 1983 by the forward-looking efforts of its eight member counties to save rail lines and service abandoned by Conrail. The JRA’s public-private partnership was recognized by the World Bank as a model for public-private partnerships to stimulate rural economic development. Bloomsburg East Street railroad crossing work delayed

BLOOMSBURG – East Street’s railroad grade crossing construction will be delayed due to an accident that caused injuries to a construction worker working to prepare the railroad grade crossing work.

The work had been scheduled from Aug. 22 to 26 on East Street/State Route 487 adjacent to State Route 11. The SEDA-COG Joint Rail Authority (JRA) will alert the public when the rescheduled construction date is known.

The Market Street railroad grade crossing work between Sixth and Seventh streets will reopen Aug. 14, two days later than planned, due to paving delays. It had closed Aug. 8.

Railroad crossings in Bloomsburg to be closed for construction

BLOOMSBURG – A portion of Market and East streets will be closed to traffic for railroad crossing work in August.

The existing grade crossings are deteriorated, and the SEDA-COG Joint Rail Authority (JRA) and its private operator, North Shore Railroad, will replace them with new concrete grade crossings.

Market Street between Sixth and Seventh streets will close the morning of Aug. 8 and will reopen Aug. 12.

East Street/State Route 487 adjacent to State Route 11 will close the morning of Aug. 22 and will reopen Aug. 26.

Marked detours will be in place. Motorists are urged to slow down, be alert, and expect delays in travel.
